Efforts to clean downtown business could head to court

The next phase in efforts to clean up a vacant downtown business in Linton could come via an engineering study, public health officials, or in court, via a lawsuit filed by adjoining business owners.

The city also could seek input from the Greene County Health Department regarding whether pigeon droppings inside the 15 N. Main St. property could constitute a public health risk, seeking sanctions against owner Danny Leigh.

However, Linton city attorney Timothy Shonk noted the property's been up for tax sale, suggesting, "If (Leigh) won't pay taxes on the property, I don't know why we'd expect he'd pay fines."

Shonk won final approval Monday from the Linton City Council to hire engineers who will provide the city with a structural study on 15 N. Main St., the former home of Main Street Mortgage.

The study's intended to determine what damage might occur should the city or the business owner demolish the property, as well as whether it can be saved structurally.

Firewalls are believed to exist between the business and its neighbors, the Strawberry Patch, 49 N. Main St., and Elliott Insurance Agency, 13 N. Main St.

Those could protect the two properties from damage if the troubled building must be torn down, though the engineering study will provide a better idea.

That property has been declared an nuisance and could be deemed unsafe under City Ordinance 94.17 (K). The city requested Leigh rectify problems last summer.

Leigh responded to Shonk in a letter Sept. 12, 2010 by saying he'd hired clean-up crews. However, last week he said he's unsure he even still owns the property, believing it was sold at a tax sale.

However, the Greene County Recorder and Assessor's records still list Leigh as the owner.

Some work's been done, but holes in the property's ceiling remain, allowing in pigeons who've cluttered the property with droppings, feathers and dead birds.

Black mold is also believed to be present in the property.

Strawberry Patch owner Judy Koons fears histoplasmosis, a disease caused by fungus in the bird droppings which could cause blindness, could result if the building's left uncleaned. She already has one blind spot on her left eye from suffering the disease as a child.

Koons and her family said the property's so blighted by birds they believe clean-up crews will likely "need haz-mat suits" to clear away the bird dung and feathers.
